Verkoopvoorwaarden – Sales Conditions & Terms
Deze Voorverkoop Voorwaarden, hierna te noemen “Voorwaarden” zijn van toepassing op het plaatsen van pre-orders hierna te noemen “Voorverkoop orders” bij Futureworld Orchestra, hierna te noemen (“wij”, “ons”, of ” FWO “) voor al onze producten. Lees deze Voorwaarden zorgvuldig alvorens uw Voorverkoop van enig FWO Product te plaatsen. Door het indienen van uw Voorverkoop order gaat u ermee akkoord wettelijk gebonden te zijn aan deze voorwaarden.
- Voorverkoop Order
Bij het plaatsen van een Voorverkoop order voor FWO Producten wordt u verzocht bepaalde informatie te verstrekken, zoals uw adres- en factureringsgegevens. U verklaart en garandeert dat al deze informatie juist is, en u zult ervoor zorg dragen dat deze informatie actueel wordt gehouden. FWO heeft geen verantwoordelijkheid of aansprakelijkheid voor onnauwkeurige informatie of informatie die later verouderd raakt, en heeft geen verplichting inspanningen te verrichten om de juiste contact- of verzendinformatie te achterhalen. U kunt uw informatie op elk moment voordat uw product wordt verzonden bijwerken door een e-mail te sturen naar contact@futureworldorchestra.com.
U erkent en stemt ermee in dat FWO reserveringen mag weigeren of uitstellen om overinschrijving te voorkomen of naar eigen goeddunken, mits wij ons zullen inspannen om u binnen twee (2) weken na ontvangst van uw Voorbestelling te informeren, en dat u recht heeft op volledige terugbetaling van de aankoopprijs.
- Betaling
De volledige Prijs van de Producten zal u in rekening worden gebracht op het moment van het plaatsen van de Voorverkoop order. Indien FWO niet in staat is de verzending van de Producten aan te vangen op of voor het tijdstip waarop u de Voorbestelling hebt geplaatst, zal FWO een volledige terugbetaling aan u verrichten. Uw plaatsing van een Voorbestelling houdt uw uitdrukkelijke instemming in met FWO om de volledige Prijs van de Producten op dat moment in rekening te brengen.
- Creatieve vrijheid
FWO zal Producten welke onder deze Voorwaarden vallen zoveel mogelijk creatief vormgeven op de manier waarop Producten in de Voorverkoop periode zijn aangeboden en op basis waarvan u Producten aanschaft. Dit betekend dat FWO de vrijheid heeft om creatieve aanpassingen te maken zonder vooraf kennis hiervan te hoeven geven. Het is voor u niet mogelijk om op basis van creatieve wijzigingen de Voorverkoop order in te trekken en zal van enige terugbetaling ook geen sprake kunnen zijn. FWO zal echter eventuele creatieve wijzigingen zo minimaal mogelijk te laten zijn en altijd proberen om binnen de “creatieve geest/domein” van de aangeboden Voorverkoop producten blijven. - Voorverkoopperiode en levertijd.
Voorverkoopperiode.
FWO kan ten alle tijde en zonder opgaaf van redenen de Voorverkoop periode verlengen, verkorten of staken. Producten die reeds in enig Verkoop periode zijn verkocht zullen conform deze Voorwaarden worden geleverd.
Levertijd.
Hoewel FWO zich zoveel mogelijk zal inspannen om zich aan de levertijden van Producten te houden conform hetgeen is aangeboden als Voorverkoop product, begrijpt u en stemt u ermee in dat er vertragingen kunnen optreden. Een geschatte levertijd is slechts een schatting, is onderhevig aan verandering, en FWO verklaart of garandeert niet dat zij in staat zal zijn het Product op de geschatte datum te verzenden. Als gevolg hiervan is FWO, in het geval dat een vertraging ontstaat en de geschatte verzending en/of vrijgave van het Product niet wordt gehaald, niet verantwoordelijk voor enige schade die kan ontstaan als gevolg van de vertraging, noch zal FWO verplicht zijn, behalve zoals uiteengezet in deze Voorwaarden, tot het verstrekken van enige kortingen, terugbetalingen of credits als gevolg van dergelijke vertragingen. Wij zullen u periodiek op de hoogte houden van het leveringsschema.
Uitzondering. Vanaf het moment dat uitstel van de levering van het voorverkoop product één jaar bedraagt heeft u het recht op annulering van de aankooporder en terugbetaling van het gehele aankoopbedrag. Om gebruik te maken van dit recht dient u zelf het initiatief hiertoe te nemen en een annuleringsverzoek te sturen per email naar: support@futureworldorchestra.com. Deze situatie kan nooit leiden tot enige schade en FWO kan niet aansprakelijk worden gesteld.
- Prijs
De aankoopprijs, hierna te noemen “Prijs”, is inclusief btw en andere overheidsheffingen, die onder uw verantwoordelijkheid vallen. Als de Prijs daalt nadat u een voorbestelling hebt geplaatst, betalen wij u het verschil terug. Als de Prijs stijgt, is uw bestelling tegen de lage Prijs verzekerd, tenzij de prijs meer dan 10% stijgt. De Prijs geldt vanaf het moment dat u de voorbestelling plaatst tot het moment dat u het artikel heeft ontvangen. Om een terugbetaling van het verschil te vragen, stuurt u ons een e-mail op: support@futureworldorchestra.com.
Indien de Prijs van uw voorbestelling meer dan 10 procent stijgt, bijvoorbeeld door onvoorziene inkoop prijsstijgingen, zullen wij u wellicht verzoeken tot een nabetaling. U heeft dan echter de mogelijkheid om uw aankooporder in te trekken en zullen wij u uitsluitend en alleen het bedrag dat u aan ons heeft betaald binnen 31 dagen nadat u aan ons de intrekking heeft kenbaar gemaakt retourneren, via e-mailadres: support@futureworldorchestra.com.
- Annulering
Voorverkooporders kunnen kosteloos worden geannuleerd tot 14 dagen na aanschaf van enig Voorverkoop product. Het aankoopbedrag zal alsdan binnen 31 dagen aan u worden geretourneerd zonder aftrek van administratie- c.q. verwerkingskosten. Annuleringen dienen uitsluitend schriftelijk kenbaar te worden gemaakt via e-mailadres: support@futureworldorchestra.com.
FWO behoud zich het recht voor om zonder opgaaf van reden de aankooporder te kunnen annuleren en de levering van enig product op elk moment te kunnen staken en gestaakt te houden. FWO verplicht zich een eventuele staking aan u te melden. In dit geval heeft u recht op volledige teruggave van het aankoopbedrag echter zonder dat wij over het aankoopbedrag rente en/of overige bedragen verschuldigd zullen zijn. Wij brengen ook geen administratie- en verwerkingskosten in rekening. Annulering door FWO kan nooit lijden tot schade van welke aard ook.
- Beperking van aansprakelijkheid
Onder geen enkele omstandigheid zal FWO aansprakelijk gesteld kunnen worden voor enige incidentele, speciale of gevolgschade voortkomend uit of gerelateerd aan deze overeenkomst. In het geval dat FWO aansprakelijk wordt gesteld voor enige schade die voortvloeit uit of verband houdt met deze overeenkomst, zal uw enige en exclusieve remedie de volledige terugbetaling van uw aankoopprijs zonder rente zijn.
- Voorwaarden en bepalingen van de verkoop
Op de aankoop van de Producten zijn aanvullende voorwaarden van toepassing die door FWO worden verstrekt, inclusief intellectueel eigendom dat in de Producten is belichaamd of gegevens die door de Producten zijn verzameld. De huidige Verkoopvoorwaarden zijn te vinden in de footer van deze website en kunnen zonder voorafgaande kennisgeving worden gewijzigd. Uw aankoop van het Product zal onderworpen zijn aan deze algemene voorwaarden en het terugbetalingsbeleid.

- Disclaimer
FWO wijst alle garanties af, expliciet of impliciet, met betrekking tot het aangeboden voorverkoop product dat door FWO wordt aangeboden, of dat nu voor of na uw voorverkoop order is. U begrijpt en gaat ermee akkoord dat het voorverkoopproducten momenteel in ontwikkeling zijn en dat het product dat uiteindelijk beschikbaar komt voor aankoop door u wezenlijk kan verschillen van het aangeboden voorverkoopproduct.
- Wijzigingen in de Voorwaarden
FWO behoudt zich het recht voor de voorwaarden te wijzigen, om welke reden dan ook of zonder opgaaf van reden. Wij zullen u van alle wezenlijke veranderingen op de hoogte stellen en, indien u niet tevreden bent met dergelijke veranderingen, is uw enige en exclusieve remedie om uw reservering te annuleren zoals beschreven in Sectie 6 hierboven.
- Diverse bepalingen
Deze Voorwaarden vormen de volledige overeenkomst tussen de partijen met betrekking tot het onderwerp ervan en deze vervangt alle eerdere overeenkomsten, verklaringen en afspraken van de partijen. Deze Overeenkomst wordt beheerst door en zal worden geïnterpreteerd in overeenstemming met de wetten van de Nederlandse staat. De locatie voor alle acties met betrekking tot het onderwerp of de handhaving van deze Overeenkomst zal in Nederland zijn, de plaats waar deze Overeenkomst is aangegaan en moet worden uitgevoerd. U mag deze Overeenkomst of de rechten die u op grond van deze Overeenkomst worden verleend niet overdragen.
