Affiliate Terms & Conditions

As an authorised affiliate (hereinafter referred to as Affiliate) of Futureworld Orchestra, you agree to abide by the terms and conditions contained in this agreement (hereinafter referred to as Agreement). Please read the entire Agreement carefully before registering and promoting yourself as an Affiliate of Futureworld Orchestra.
Your participation in the FWO Affiliate Programme (hereinafter referred to as: Programme) is solely for the purpose of legally advertising our products (hereinafter referred to as: Affiliate products) and receiving a commission (hereinafter referred to as: commission) on products purchased by persons referred to Futureworld Orchestra through your own website, email, shop. By applying for the Programme, you indicate your agreement to this Agreement and its terms and conditions.

1. Approval or rejection of application

We reserve the right to approve or reject any application for admission to the Programme at our sole discretion. You have no legal recourse against any rejection.
Commissions

2. Commissions

Commissions are paid once a month. To receive commissions as an Affiliate, the referred account must remain active for a minimum of 2 months. Your own orders are excluded from the Programme.

There is a limit of one commission per referral and you will only receive a commission on FWO products allocated to the Programme.
Payments are sent only for transactions that have been successfully completed, for which no returns have been made and only after the return period has expired (30 days). Transactions resulting in chargebacks or refunds will not be paid.

The commission rate is a minimum of 20% and is subject to change without prior notice and notification. The percentage is visible in the affiliate account.

3. Termination

Your affiliate application and status in the Programme may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
Spam (mass e-mail, mass newsgroup posting, etc.).
Advertising on sites containing or promoting illegal activities.
Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under any applicable Dutch state laws.
Violation of intellectual property rights. Futureworld Orchestra reserves the right to require licence agreements from those using Futureworld Orchestra trademarks to protect our intellectual property rights.
Offering discounts, coupons or other form of promised kickbacks from your affiliate commission as an incentive. However, adding bonuses or bundling other products with Futureworld Orchestra is acceptable.
Self-referrals, fraudulent transactions, suspected affiliate fraud.

In addition to the foregoing, Futureworld Orchestra reserves the right to terminate an Affiliate account at any time and without reason.

4. Affiliate Links

You may use both graphic and text links on your website, in your email messages and shop. You may also advertise the Futureworld Orchestra site in online and offline classified ads, magazines and newspapers. You may use the graphics and text provided by us, or you may create your own graphics and text, so long as they are deemed appropriate under the Terms and do not violate the provisions of Condition 3.

5. Coupon and Deal Sites

Futureworld Orchestra occasionally offers coupons to selected affiliates and to our newsletter subscribers. If you are not pre-approved/not assigned a branded coupon, you may not promote the discount coupon. Below are the terms and conditions applicable to any affiliate considering promotion of our products in connection with a deal or coupon:

Members may not use misleading text on affiliate links, buttons or images to imply anything other than currently authorised deals for the specific affiliate.
Affiliates may not offer Futureworld Orchestra coupons, Futureworld Orchestra discounts or other expressions suggesting that coupons are available.
Affiliates must not generate pop-ups, pop-unders, iframes, frames or other visible or invisible actions that set affiliate cookies unless the user has shown a clear and explicit interest in activating a specific savings by clicking on a clearly marked link , button or image for that specific coupon or deal. Your link should send the visitor to the merchant’s site.
The user must be able to see information and details about coupons/deals/savings before an affiliate cookie is set (i.e. ‘click here to see coupons and open a window to the merchant’s site’ is NOT allowed).
Affiliate sites may not have ‘Click for (or to see) Deal/Coupon’ or some other variant, if no coupons or deals are available, and the click opens the merchant’s site or sets a cookie. Partners with such text on the merchant’s landing page are immediately removed from the programme.
Pay Per Click (PPC) policy

6. PPC bidding is NOT allowed without prior written consent.

7. Liability

Futureworld Orchestra shall not be liable for indirect or accidental damages (loss of revenue, commissions) resulting from affiliate tracking errors, loss of database files or any result of intentional damage to the Programme and/or to our website(s). We make no express or implied warranties in relation to the Programme and/or memberships or products sold by Futureworld Orchestra. We do not claim that the operation of the Programme and/or our website(s) will be error-free and we are not liable for any interruptions or errors.

8. Duration of the Agreement

The term of this Agreement begins upon your acceptance into the Programme and ends when your Affiliate account is terminated. The terms of this Agreement may be amended by us at any time. When changes are made, we will notify you by email. If any change to the terms of this Agreement is unacceptable to you, your only option is to terminate your Affiliate account. Your continued participation in the Programme constitutes your acceptance of any change.

9. Indemnification

The Affiliate shall indemnify and hold harmless Futureworld Orchestra and its affiliates and subsidiaries, officers, directors, employees, licensees, successors and assigns, including those licensed or authorised by Futureworld Orchestra to transmit and distribute materials, from any and all liabilities, damages fines , judgements, claims, costs, losses and expenses (including reasonable legal fees and costs) arising out of or in connection with any claims incurred in connection with this Agreement as a result of negligence, misrepresentation, non-disclosure or wilful misconduct of affiliates.

10. Acceptance of the above Terms and Conditions

By registering for the FWO Affiliate Programme, you confirm that you have carefully read, understood and unreservedly accepted these terms and conditions. Participation in the programme and use of the services and benefits arising therefrom is only permitted upon acceptance of these terms and conditions.

If you do not agree to one or more provisions, you cannot register or participate in the FWO Affiliate Programme. You further declare that you agree that these terms and conditions are binding and remain applicable throughout your participation in the programme, or until participation is terminated in any way.

11. Governing law, jurisdiction and attorney’s fees

This Agreement shall be governed by and construed in accordance with the laws of the Netherlands. Any dispute arising out of or in any way related to this Agreement shall be exclusively adjudicated by the District Court in Almelo.
